Terms of Service

The rules for using BunaMia and posting listings on the platform.

1. Who We Are

BunaMia (the "Platform") is operated by Oleksandr Dziuba, a natural person domiciled in Bratislava, Slovakia, reachable at info@bunamia.ro. Where these Terms say "we" or "us", they refer to that person in their capacity as operator of the Platform.

The Platform is in an early testing phase and is offered free of charge. We charge no fees, take no commission on any booking, and process no payments. We may in future introduce paid features, advertising, or promoted listings; if we do, we will update these Terms and inform you before the change affects you.

2. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Platform. By creating an account or using the Platform you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

3. Eligibility and Your Account

You must be at least 18 years old to create an account, and by registering you confirm that you are. You alone are responsible if you declare an age that does not match reality. We may close any account we reasonably believe belongs to a person under 18.

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised use.

4. What the Platform Is, and What It Is Not

BunaMia lets users publish listings and discover beauty and self-care specialists. We provide the venue only.

We are not a party to any agreement, appointment, or transaction between users. We do not perform the services advertised, do not employ or represent any specialist, do not process payments, and do not verify in advance the identity, qualifications, permits, or insurance of any user. We do not guarantee the quality, safety, legality, or accuracy of any listing or service.

The presence on the Platform of a profile, photograph, badge, like count, or any other information does not by itself constitute an endorsement by us, nor a verification of anyone's identity, qualifications, permits, or experience, unless a specific verification is expressly identified as such.

Any contract, appointment, payment, or dispute arising from a listing is exclusively between the users concerned. We encourage you to verify a specialist's credentials yourself before engaging them.

The Platform stores and displays information provided by its users, at their request. In relation to that content we act as a hosting service provider within the meaning of Article 6 of Regulation (EU) 2022/2065 (the Digital Services Act): we do not initiate transmissions, do not select their recipient, and do not select or modify the content of listings.

Accordingly, we are not liable for content stored at a user's request, provided we do not have actual knowledge of its illegality and that, upon obtaining such knowledge, we act expeditiously to remove it. We have no general obligation to monitor the content we store (Article 8 DSA), and the voluntary checks we carry out on our own initiative do not cause us to lose this exemption (Article 7 DSA).

6. Your Content and Listings

You are solely responsible for the listings, images, messages, and other content you post ("Your Content"). By posting, you confirm that:

  • a) You own the content or have the rights needed to post it
  • b) The content is accurate and not misleading
  • c) The content does not infringe anyone's rights or the law
  • d) You have obtained the consent of any person whose personal data or image you publish, including clients shown in portfolio photographs
  • e) You hold any permits, licences, or qualifications required by law for the services you offer

You retain ownership of Your Content. You grant us a non-exclusive, royalty-free licence to host, store, display, and distribute Your Content on the Platform for the purpose of operating and promoting the service. This licence ends when you delete the content or your account, except for copies retained as required by law or as described in our Privacy Policy. We do not undertake to store or back up Your Content. Please keep your own copies.

7. If You Offer Services Through the Platform

You act in your own name, as an independent provider. You represent that you hold every authorisation, sanitary approval, qualification, and insurance that the law requires for the services you offer, and that you comply with your own registration and tax obligations.

Client data you receive through the Platform (names, phone numbers, messages, photographs) you process as an independent data controller, on your own account. You are solely responsible for complying with the GDPR in respect of it.

8. Prohibited Content and Conduct

You must not post content or use the Platform to:

  • a) Offer illegal goods or services
  • b) Post false, fraudulent, or misleading listings
  • c) Make false or misleading claims about your qualifications or results
  • d) Publish others' personal data without consent
  • e) Publish health data or other special categories of personal data (your own or your clients') without a lawful basis and the necessary safeguards
  • f) Post sexual, violent, hateful, or discriminatory content
  • g) Post content that exploits or endangers minors
  • h) Post fake reviews, or manipulate likes, favorites, or catalogue visibility in any way
  • i) Harass, threaten, or insult another user, or address them in vulgar or offensive language, including in private messages
  • j) Contact another user repeatedly and unwantedly, or request services from them without any real intention of using them
  • k) Offer sexual, escort, or companionship services, or any services with a sexual connotation
  • l) Infringe copyright, trademarks, or other rights
  • m) Send spam or unsolicited advertising
  • n) Impersonate others or misrepresent your identity
  • o) Distribute malware or attempt to disrupt the Platform
  • p) Scrape or harvest data from the Platform, or access it by automated means
  • q) Create a new account after we have suspended or closed a previous one

9. Moderation, Removal, and Reporting Illegal Content

We are not obliged to pre-screen content, but we may review, moderate, edit, or remove any listing and restrict or suspend any account that violates these Terms or applicable law. We will inform the affected user of the reason; where content appears manifestly illegal or presents a risk to user safety, we may remove it immediately and give reasons afterwards.

If you consider a listing illegal or in breach of these Terms, use the "Report" button on the listing page, or contact us at info@bunamia.ro. This address is also our single point of contact for users and authorities under the DSA. A useful report identifies the material concerned, where it is on the Platform, and why you consider it illegal. We review reports without undue delay, and where you report while logged in you will receive a response about the outcome.

10. Intellectual Property

The BunaMia name, logo, design, and software are owned by the Platform operator. You may not copy, modify, or reuse them without our written permission. Using the Platform grants you a limited, personal, non-transferable right to access it for its intended purpose.

If you believe that content published on the Platform infringes your copyright or other intellectual property rights, write to us at info@bunamia.ro, identifying the content, the rights you rely on, and your contact details. We may disable the reported content until the matter is clarified and will inform the user who posted it, who must permanently remove it if the complaint is well-founded. If that user does not comply, we may restrict or suspend their account. The same procedure applies to portfolio photographs that do not belong to the user who published them.

Profiles and listings may contain links to users' own websites and social networks (Instagram, Facebook, WhatsApp), and the Platform relies on services provided by third parties. Those sites and services are controlled by third parties, have their own terms and privacy policies, and we are not responsible for their content, operation, availability, or security.

12. Availability and Changes to the Platform

We may at any time modify, restrict, suspend, or discontinue any feature or the Platform as a whole. Where we discontinue it permanently, we will give reasonable advance notice so that you can retrieve your content. We do not guarantee uninterrupted or error-free operation, nor that content will be preserved.

13. Warranties and Liability

The Platform is made available as is and as available. We make reasonable efforts to keep it functioning correctly and securely, but we do not warrant that it will be uninterrupted or error-free. We give no warranty as to the users of the Platform: their identity, qualifications, permits, insurance, or honesty, or the quality, safety, or legality of what they offer.

Nothing in these Terms excludes or limits our liability for intentional fault or gross negligence, for death or injury to life, bodily integrity, or health, or for any other liability that cannot lawfully be excluded, including the mandatory rights you have as a consumer.

Subject to that, and to the extent permitted by law, we are not liable for the acts, omissions, content, or services of any user (including any harm or loss arising from a service obtained from a specialist found through the Platform, or from any meeting or transaction between users), nor for indirect or consequential loss. Our liability, where it arises, is limited to direct and foreseeable damage caused by our own act or omission. Because the Platform is provided free of charge, we owe no obligation of result as to its availability.

If you use the Platform in the course of a business or profession (in particular if you publish listings offering services), you agree to indemnify us against any third-party claim arising from Your Content, from the services you perform, or from your breach of these Terms. This clause does not apply to consumers using the Platform for private purposes.

14. Suspension and Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or applicable law, or if required to protect the Platform or other users. On termination, the licence you granted for Your Content ends, subject to the records described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or via a notice on the Platform, and where the change is material we will ask you to accept the updated Terms before continuing. If you do not accept them, you may stop using the Platform and delete your account.

16. Governing Law and Contact

These Terms are governed by the laws of the Slovak Republic and of the European Union, without prejudice to the mandatory consumer-protection rules of your country of residence. Please write to us first at info@bunamia.ro. We prefer to resolve problems informally. This does not affect your right to bring a claim before the competent courts.

We may transfer our rights and obligations under these Terms to a legal entity we establish to operate the Platform, or to a successor to the business, provided your rights are not affected. We will inform you by a notice on the Platform or by email.

If any provision of these Terms is found to be invalid, the remaining provisions continue in force.
